COVID-19 Waiver & Release

An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. The State of California strongly recommends that all ticket holders, guests, and attendees (collectively “Attendees”) of OC Cherry Blossom Festival (“OCCBF” or “Event”) be fully vaccinated or receive a negative COVID-19 test prior to entering the Event. Attendees must practice “social distancing” at the Event. Unvaccinated Attendees must wear face coverings at the Event. If planning to travel to Event, please follow Centers for Disease Control and Prevention (“CDC”) and California’s recommendations and travel advisories. Do not travel or attend the Event unless you are free of any COVID-19 symptoms and otherwise comply with the requirements of such advisories and restrictions.
By attending the Event, Attendees are certifying that Attendees (1) are not experiencing any symptoms of COVID-19, identified by the CDC, including, fever, chills, cough, shortness of breath or difficulty breathing, fatigue, muscle or body aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, and/or diarrhea; (2) have not been in contact with someone with confirmed or suspected COVID-19 symptoms; and (3) are not under any quarantine order. Attendees who cannot certify all of the above criteria must not enter or attend the Event. By attending the Event, Attendees acknowledge that Attendees understand and will abide by all health and safety requirements. OCCBF reserves the right to eject Attendees if they fail to comply with any of these rules or OCCBF’s enforcement of these rules.
By attending OCCBF, all Attendees voluntarily assume all risks related to Event, including without limitation, risk of exposure to COVID-19. OCCBF cannot and does not guarantee that Attendees will not become infected with COVID-19. Any Attendees attending the Event, on his/her own behalf, and on behalf of Attendees’ heirs, executors, administrators, legal representatives and assigns (hereinafter collectively, “Releasor”, which terms shall also include Releasor’s parents or guardian, if Releasor is under 18 years of age) acknowledge that Releasor willingly and voluntarily engages in the Event, and Releasor hereby releases, waives and forever discharges any and all liability, claims, suits, and demands of whatever kind or nature against OCCBF, OC Cherry Blossom Festival LLC, Code 4 Media Group, Inc., and affiliated partners and sponsors, including without limitation, each of their directors, officers, owners, employees, agents, and volunteers (“Releasees”), either in law or in equity, to the fullest extent permissible by law, damages or losses caused by negligence, fault or conduct of any kind on the part of the Releasees, including without limitation, death, bodily injury, illness, economic loss, out of pocket expenses, or loss or damage to property, which arise or relate to Attendees’ participation in the Event (“Release”).
By attending the Event, Attendees understand and agree that this Release means Attendees give up, among other things, all rights to sue Releasees for injuries, damages or losses Attendees may incur in connection to the Event. Releasor also understands that this Release binds Releasor’s heirs, executors, administrators, legal representatives and assigns. Releasor also affirms that Releasor has adequate medical or health insurance to cover any medical care Releasor may require.
By attending the Event, Releasor certifies that Releasor has read this entire Release, fully understands the entire Release, and agrees to be legally bound by the Release to the fullest extent permitted by law.
